By accessing or using PainPointer.com (the “Service”), you agree to the following terms and conditions. If you do not agree, do not use the Service.

1. Who We Are

The Service is provided “as-is” operated by an individual founder based in the Netherlands and not yet formally incorporated as a business entity.

2. What the Service Does

PainPointer.com is a web application that automatically identifies business opportunities by scanning Reddit posts and summarizing customer pain points using OpenAI’s API. The service is automated, and usage is based on a credit system.

3. Eligibility

You must be at least 16 years old to use this service. By using the Service, you confirm that you meet this requirement.

4. Account Registration

You can use the Service anonymously for a limited trial. To access more features, you must create an account. You may register using email or your Google account. Users may share accounts, but are responsible for all activity under their login.

5. Credits and Payments

The Service operates on a credit-based system:

  • Unregistered users get 1 free scan.
  • Registered users get 3 free credits.
  • Additional credits can be purchased via Stripe.
  • Credits are delivered instantly. Refunds are available only if purchased credits are unused.

6. Use of the Service

You are granted a non-exclusive, limited license to access and use the Service. You may:

  • View and save results for personal or business use.
  • Share insights derived from the tool.

You may not:

  • Abuse rate limits or attempt automated scanning beyond normal use.
  • Resell the Service or claim ownership of its outputs as-is.
  • Reverse-engineer or exploit the system.

7. Data Collection & Privacy

We collect:

  • Account details (email, Google login info via Supabase)
  • Usage data (e.g., scans, saved pain points, credit balance)
  • Basic analytics data (via Google Analytics and Vercel)
  • IP addresses for demo abuse prevention (automatically deleted after 30 days)

We do not sell your data. By using the Service, you consent to this data being stored and processed in line with industry norms.

7.1. IP Address Collection

We temporarily store your IP address when you use our free demo to prevent abuse and ensure fair access for all users. This data:

  • Is used solely to limit demo usage to once per IP address
  • Is not used for tracking, profiling, or marketing purposes
  • Is automatically deleted after 30 days
  • Is not shared with third parties

8. User-Generated Content

Users may add and save custom pain points. You retain rights to anything you manually enter, but we may store it to deliver the Service.

9. Termination

We may suspend or terminate access if we detect abuse, fraud, or harmful behavior. Unused credits may be forfeited in cases of serious abuse.

10. Availability & Warranty Disclaimer

The Service is provided “as-is” and “as available.” We don’t guarantee uninterrupted access, accuracy, or compatibility with your devices. Use it at your own risk.

11. Limitation of Liability

To the fullest extent allowed by law, we are not liable for any damages, losses, or claims arising from your use of the Service.

12. Indemnification

You agree to indemnify and hold PainPointer.com and its operator harmless from any claims or disputes related to your use of the Service.

13. Changes to Terms

We may update these Terms at any time. Changes will be posted here. Continued use means you accept the new terms.

14. Governing Law

These Terms are governed by Dutch law. Any legal disputes must be handled in the Netherlands.

15. Dispute Resolution

Before taking legal action, you agree to contact us first to attempt an informal resolution.
